TAFE teachers challenge ruling on hours

The NSW Teachers Federation is appealing against a recent decision that it says will impose "disgraceful" working conditions on TAFE teachers.

The Industrial Relations Commission (IRC) last month found in favour of the NSW Department of Education and Training (DET) in a long-running dispute about TAFE teachers' pay and conditions.

The teachers earlier this year won a pay rise of four per cent, 1.5 per cent above the state government's public sector wage cap.

But the DET applied to the IRC to increase teaching hours as a productivity trade-off for the increase.

The IRC found in favour of the DET on October 15, but the Teachers Federation is appealing the decision in the NSW Court of Appeal on a point of law.

It is applying to have two judges removed from the case, because they were also involved in the conciliation process, and thus have the decision overturned.

Teachers Federation president Bob Lipscombe told reporters in Sydney on Tuesday the IRC had made an unfair call.

"The decision itself is quite a disgraceful decision, it really reflects (the Howard government IR regime) Work Choices visited on TAFE teachers of NSW," he said.

"The decision increases the working week of TAFE teachers by five hours and values each of those hours at less than $3.

"It now requires TAFE teachers to work any time between six in the morning and 10 at night six days a week. No one else is compelled to work across such hours."

TAFE teachers staged a 24-hour strike in September and Mr Lipscombe said he would not rule out further industrial action.

"We're calling on all TAFE teachers next week about how we take this action further," he said.

It was only a matter of time before all NSW teachers were offered the same working conditions, Mr Lipscombe said.

"School teachers are very angry too. They'll take action now if necessary," he said.
