A Sydney man has failed to prevent his retrial for the 1993 murder of his parents.
In the NSW Supreme Court on Friday, Justice Graham Barr confirmed the trial date of October 13 for Jeffrey Gilham.
In April, a jury failed to reach a verdict on whether Gilham, 37, was guilty of murdering his parents Helen, 55, and Steven, 58, at their Sydney home in 1993.
In 1995, Gilham pleaded guilty to the manslaughter of his brother Christopher on the same day, saying he was provoked after discovering Christopher had killed their parents.
But he was tried this year for their murder.
After the jury at the double murder trial failed to reach a verdict, Gilham's lawyers asked for the charges to be "no-billed", which would mean he would not be tried again.
But Justice Barr was told earlier this month that the NSW Director of Public Prosecutions, Nicholas Cowdrey, QC, had decided the retrial should go ahead.
The trial judge will be Justice Roderick Howie and the crown prosecutor will be Margaret Cunneen, SC.
