Terms and conditions for submitting news material

Nine Network Australia Pty Limited (ACN 008 685 407) ("Nine") welcomes and encourages you to provide us with your images, photographs and video footage (“Footage”) of newsworthy events, for the use of Nine and its affiliates.

In submitting Footage to us, you agree to the terms, conditions, disclaimers and notices in this document (“Terms”) and (where not inconsistent) elsewhere on the ninemsn website (www.ninemsn.com.au). Nine reserves the right to amend the Terms at any time. You should refer to them periodically, and each time prior to submitting any Footage.

How to submit Footage

We will accept most standard formats for images, photographs and video footage, including digital and analogue. We would prefer that any Footage submitted to us does not exceed 2-3 minutes in duration.

You can submit Footage to us by any of the following means:

1. If you have a mobile phone capable of storing and sending images, photographs or video footage, you can send the Footage by your mobile phone to the dedicated number 0405 999 999. Standard carrier charges apply;

2. You can send Footage attached in a link by e-mail to 9newsatch@nine.com.au

3. You can send Footage as an attachment to your on-line submission form on the dedicated web page for the Citizen Journalist project, www.ninemsn.com.au/9newswatch and

4. You can submit Footage by registered mail to Nine Newsroom, 24 Artarmon Road, Willoughby, NSW 2068. (collectively, “Footage Services”)

What we will do:

We will aim to review all Footage which is in a readable format.

After review, we will decide, in our absolute discretion, whether to use the Footage, and if we do decide to use it, in what media it will be shown.

We may edit or modify any Footage in any manner we, in our absolute discretion, consider appropriate.

We will not use all Footage received, and we make no warranties in this regard, nor do we warrant that we will review all Footage submitted.

Licence and rights

In submitting Footage through the Footage Services, you grant to Nine an exclusive, worldwide, perpetual, transferable, royalty-free licence to use, copy, reproduce, edit, modify and exploit the Footage in any media, and to sublicence such rights to others, for any purpose whatsoever, including but not limited to:

(i)Recording the Footage by any means;

(ii)Incorporating the Footage in news reports or other programmes;

(iii)communicating the Footage in any medium;

(iv) advertising and promotion; and

(v) reproducing the Footage in magazines or other print media.

You consent to, and waive all moral rights in respect of, anything done in relation to the Footage by Nine or its sub-licensees in the exercise of Nine’s licence rights under these Terms. Nine or its sub-licensees may attribute you as the owner of the Footage in any use of the Footage, but you acknowledge that Nine or its sub-licensees may not include any attribution of you in their discretion, and you consent to them doing so.

You represent and warrant to Nine on a continuing basis that:

(i) You own all right title and interest (including all intellectual property rights) in the Footage;

(ii) You have the right and authority to grant to Nine the licence set out in these Terms;

(iii) You have not endangered yourself or others, or broken any laws in obtaining or providing and licensing to Nine the Footage;

(iv) The events depicted in the Footage are actual events and are not staged or fabricated; and

(v) The exercise by Nine and/or our sublicensees of any of the rights granted by you under these Terms will not at any time infringe any intellectual property right, moral right or any other right of any person.

Merchandise

If Nine determines to use your Footage, we may provide you with a gift of item(s) of our merchandise, such item(s) to be determined in our discretion.

Contact

We may contact you with respect to any queries in relation to any submitted Footage. In submitting Footage through the Footage Services, you consent to being contacted by us for any purpose related to the Footage.
